1. Introduction

These Terms and Conditions (hereinafter referred to as "Terms") constitute a binding agreement between you, the user of the application, and Bewolp Technologies Private Limited, the legal entity that owns and operates the mobile application and associated services known as "Bewolp." By accessing, browsing, installing, registering for, or otherwise using any part of the Bewolp platform, whether through a mobile application, website, or associated service interface, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions set forth in this document.

These Terms govern your rights and obligations, as well as our rights and obligations, relating to your use of the platform. If you do not agree with these Terms or cannot comply with any provision contained herein, you must immediately cease using the Bewolp platform and uninstall the application from your device. Continued use of Bewolp constitutes acceptance of all clauses, including future modifications which may be made at our sole discretion and without prior individual notice.

2. Eligibility

To use the services provided by Bewolp, you must be legally eligible to enter into a binding contract as defined by the Indian Contract Act, 1872. This means you must be at least thirteen (13) years of age to register and use the application. If you are under the age of 18, you may only use the service under the supervision and with the explicit consent of a parent or legal guardian who has also agreed to these Terms on your behalf.

You represent and warrant that: (a) You have not been previously suspended or removed from the Bewolp platform. (b) You are not a person barred from receiving our services under the laws of India or any other applicable jurisdiction. (c) The information you provide during registration is truthful and legally accurate.

Bewolp reserves the right to conduct eligibility verification at any point during your usage, and we may request proof of age or identity if required by law or internal review processes. Accounts found to be in violation of this section will be terminated without prior notice.

3. Account Responsibility

Creating a user account on the Bewolp platform requires the submission of accurate, current, and complete information. You agree to maintain and promptly update such information to keep it true and correct at all times. You must not impersonate another person, use someone else’s phone number or identity, or create an account for anyone other than yourself without prior authorization.

You are solely responsible for safeguarding your account credentials, including passwords, verification codes, linked emails, and any connected social authentication. Any activity carried out through your account will be assumed to have been authorized by you, and we are not liable for any misuse or damage resulting from third-party access unless proven to be due to our gross negligence or a platform-level security breach.

You may not share, transfer, lease, or sell your account credentials to anyone else. You also agree not to create multiple accounts, especially for the purpose of manipulating the system, violating the Terms, or evading previous bans. If you believe your account has been compromised, you must inform us immediately so that we can initiate appropriate measures, including but not limited to temporary suspension, reset protocols, or legal investigation.

4. User Conduct

As a user of the Bewolp platform, you are expected to interact with the platform, its services, and its users in a manner that is respectful, responsible, and lawful. You agree not to use the platform to engage in any activity that is unlawful, harmful, abusive, threatening, harassing, defamatory, vulgar, obscene, or otherwise objectionable. This includes but is not limited to, content that incites violence, hatred, discrimination based on religion, race, gender, sexual orientation, or disability, or any form of conduct that violates the rights of others.

You are also prohibited from transmitting any material that may promote malicious software such as viruses, worms, or Trojan horses. Furthermore, the use of bots, scripts, or automated tools to manipulate content visibility, follower counts, or user engagement metrics is strictly forbidden. The platform may monitor usage patterns, log user activity, and investigate violations. Repeated or severe misconduct may lead to temporary suspension, permanent ban, and/or legal prosecution as per applicable Indian laws.

Bewolp reserves the right, but not the obligation, to monitor, moderate, remove, or block any user-generated content that we determine violates our standards, policies, or community ethics without prior notice. Users are encouraged to report violations using in-app tools or by contacting our support team directly. We are committed to fostering a safe and inclusive environment for all users.

5. Content Ownership

All content that you create, upload, publish, or share on the Bewolp platform remains your intellectual property. This includes photos, videos, text posts, comments, profile details, and any other material submitted to the platform. However, by sharing such content through Bewolp, you grant Bewolp Technologies Private Limited a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, display, distribute, prepare derivative works of, promote, and otherwise utilize such content in connection with the platform’s operation, development, marketing, and legal compliance.

This license is granted for the duration of your use of the platform and continues even after you deactivate your account or delete specific content, for the purpose of archival, dispute resolution, or legal audits, unless otherwise required by applicable laws. We will never sell your user-generated content to third parties for commercial gain without your explicit consent.

You acknowledge and agree that you are solely responsible for the content you submit and that you possess all the necessary rights and permissions to do so. You must ensure that your content does not infringe upon any copyright, trademark, patent, trade secret, moral right, or privacy right of any third party. If your content is found to violate any legal or ethical standards, we reserve the right to remove it and, where appropriate, report it to legal authorities.

Bewolp may also make editorial changes to content formats (such as cropping, resizing, or compressing images) for technical optimization and visual consistency across different devices and display environments. You waive any moral rights to object to such formatting or presentation, provided your content is not misrepresented in context or intention.

6. Privacy and Data Use

At Bewolp, we are committed to protecting the privacy and personal information of all our users. When you use our platform, we collect various categories of personal data including but not limited to your name, mobile number, email address, IP address, real-time location, device identifiers, and behavioral metadata. This data is collected to personalize your experience, enhance security, ensure service delivery, and comply with applicable laws and regulations.

Your personal data may be stored on secure servers located within India or abroad and may be processed by third-party service providers who are bound by strict confidentiality obligations. Bewolp ensures that any such data processing is compliant with the Information Technology Act, 2000, and the General Data Protection Regulation (GDPR) where applicable. We implement robust encryption, access control mechanisms, and periodic audits to protect your data from unauthorized access, misuse, or breaches.

Users have the right to access their personal data, request corrections, opt-out of certain types of processing, and delete their account entirely through the privacy settings available in the app. However, certain data may be retained after account deletion for the purpose of fraud prevention, legal compliance, and dispute resolution.

By using the Bewolp platform, you acknowledge and agree to our Privacy Policy, which explains in greater detail how your data is handled. If you disagree with any aspect of our data practices, you must immediately discontinue your use of the platform. We may update our Privacy Policy from time to time, and it is your responsibility to review those changes regularly.

7. Location Services

Bewolp’s core functionality relies heavily on accurate and real-time location data. Our hyperlocal social discovery features, including the ability to connect with nearby users and explore location-sensitive interactions, are designed to enhance your awareness of and connection to people and communities around you. To achieve this, the platform may request access to your device's GPS functionality and related location services. This access is voluntary but necessary for full functionality of the app.

Location data collected may include coordinates, movement patterns, time stamps, and proximity-based triggers that enable us to match users in real-time within specific geographic boundaries. We may store this data temporarily or aggregate it to improve service delivery and enable features such as geofencing, local visibility filters, or proximity alerts.

Location access is always subject to your consent and control. You may disable location services at any time through your device settings or the in-app privacy panel; however, this will significantly limit the usability and relevance of the Bewolp experience. We do not publicly share your location unless explicitly approved by you through the app interface. We take every reasonable step to anonymize and protect your geolocation data in accordance with our Privacy Policy and applicable data protection laws.

8. Intellectual Property

All trademarks, logos, brand names, domain names, slogans, product features, source code, UI/UX designs, audio-visual content, and written materials provided through the Bewolp platform are the exclusive intellectual property of Bewolp Technologies Private Limited. This includes both registered and unregistered intellectual property and all related proprietary rights protected under the laws of India and international conventions.

You acknowledge and agree that you may not copy, reproduce, modify, distribute, publish, display, perform, license, reverse-engineer, decompile, or create derivative works from any part of the platform's intellectual assets without the express prior written permission of Bewolp. Any unauthorized use of Bewolp's intellectual property may result in legal action including claims for damages, injunctive relief, and criminal prosecution under relevant sections of the Copyright Act, Trademark Act, and IT Act.

We value and protect our innovations and expect all users and third parties to respect our creative and commercial rights. If you believe that your intellectual property rights have been violated on our platform, please notify our legal department with evidence and claim details for prompt investigation.

9. Third-Party Services

Bewolp integrates with a variety of third-party tools and services to enhance functionality, improve user experience, and streamline operations. These third-party providers may include analytics services (e.g., Google Analytics), cloud infrastructure providers, map and geolocation services, in-app payment gateways, and other utility tools that support our backend operations and frontend features. While we make reasonable efforts to ensure that these partners uphold privacy and security standards, their services are governed by independent terms and privacy policies that are outside our control.

You understand and agree that your interactions with such third-party services through the Bewolp platform are subject to those third parties' own legal terms. Bewolp is not responsible for the content, availability, accuracy, or reliability of external sites or services and will not be held liable for any loss or damage incurred as a result of your dealings with such providers. It is your responsibility to review the privacy policy and terms of service of any third-party application or website you choose to interact with via our platform.

We may also display third-party content, advertisements, or offers from external partners. These materials are provided as-is, and their presence on the platform does not imply endorsement or guarantee by Bewolp. All third-party features may be added, removed, or modified without prior notice at our discretion.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bewolp Technologies Private Limited shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages that result from the use of, or the inability to use, the platform and its associated services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, business interruption, device failure, system corruption, or other intangible losses, even if Bewolp has been advised of the possibility of such damages in advance.

Bewolp provides all its services, content, and features on an "as-is" and "as-available" basis without any express or implied warranties of any kind. We do not guarantee that our platform will be free of bugs, viruses, or other harmful components, nor do we warrant that the service will meet your expectations or be available at all times, without interruptions, delays, or errors.

Any material downloaded or otherwise obtained through the use of the platform is done at your own discretion and risk, and you are solely responsible for any damage to your device or loss of data that results from such actions. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bewolp Technologies Private Limited and its affiliates, employees, directors, officers, agents, licensors, and partners from and against any and all third-party claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (a) your access to or use of the Bewolp platform; (b) your violation of any of the provisions of these Terms; (c) any breach of the representations, warranties, and covenants made by you herein; or (d) your infringement or alleged infringement of any third-party rights, including intellectual property rights or rights of privacy and publicity.

This indemnity obligation will survive the termination or expiration of these Terms and your use of the platform. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims and may not settle any matter without the prior written consent of Bewolp.

12. Termination

Bewolp reserves the unconditional right to suspend, restrict, or terminate your account and access to the platform at any time, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms, applicable laws, or is otherwise harmful to the platform, our interests, or other users. This includes but is not limited to fraudulent behavior, account impersonation, violation of intellectual property rights, harassment of other users, and misuse of location features.

Upon termination, all licenses and rights granted to you in these Terms will immediately cease, and you must stop using the platform. Any content or data associated with your account may be deleted or retained at our discretion, subject to applicable data retention and privacy laws.

You also have the right to terminate your relationship with Bewolp by deleting your account via the settings section in the app or submitting a written request to our support team. However, certain obligations and liabilities incurred prior to termination shall survive, including rights related to indemnification, intellectual property, dispute resolution, and limitations of liability.

13. Grievance Redressal

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Bewolp Technologies Private Limited has appointed a designated Grievance Officer who is responsible for addressing user concerns, complaints, and disputes related to the use of our platform. We are committed to responding promptly, transparently, and fairly to all grievances submitted by users in good faith.

To register a complaint, users may email the Grievance Officer at grievance@bewolp.com, clearly stating the nature of the issue, affected account details, relevant evidence, and a brief description of the relief sought. Complaints received will be acknowledged within 24 hours and resolved within 15 working days wherever feasible, subject to the complexity and legal implications of the matter.

We encourage users to exercise civility and clarity in all grievance-related communication. Abusive, baseless, or malicious complaints may be ignored and may result in account restrictions. For privacy-related concerns, data removal requests, or reporting unlawful content, please refer to our Privacy Policy and Content Guidelines.

14. Governing Law

These Terms and all matters relating to the use of the Bewolp platform shall be governed by and construed in accordance with the laws of the Republic of India. This includes, but is not limited to, provisions of the Information Technology Act, 2000, the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Indian Penal Code, 1860, and relevant provisions of civil and criminal jurisprudence as applicable from time to time.

In the event that any term or condition outlined herein is found to be inconsistent with the laws of India, such provisions shall be modified or severed to the extent necessary, and the remaining terms shall remain in full force and effect. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

By agreeing to these Terms, you consent to the application of Indian law to all interactions and disputes involving Bewolp, irrespective of your location or nationality, and waive any claim that such laws are inapplicable based on jurisdictional grounds.

15. Jurisdiction

All legal disputes, controversies, or claims arising out of or relating to the use of the Bewolp platform, including those pertaining to the interpretation, breach, or enforcement of these Terms, shall fall under the exclusive jurisdiction of the Supreme Court of India. This clause shall apply regardless of the user's country of residence, the location of access, or the physical location of servers or infrastructure used to operate the platform.

Users agree to submit to the jurisdiction of the Supreme Court of India in all legal proceedings and waive any objections regarding venue or forum. This jurisdictional clause supersedes all contrary terms expressed or implied elsewhere in this agreement or in any policy, law, or regulation, unless otherwise required by constitutional provision or a court of competent authority. If any alternative dispute mechanism is pursued, it shall be supplementary and not in derogation of the Supreme Court's primary jurisdiction as outlined here.

16. Dispute Resolution

In the event of any disputes, disagreements, or conflicts arising from your use of the Bewolp platform or interpretation of these Terms, we encourage both parties to attempt an informal resolution by contacting our support team or legal department. If the dispute cannot be resolved amicably within 30 days, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996.

The arbitration shall be conducted by a sole arbitrator appointed by mutual consent or, failing that, by the Hon’ble High Court of Kolkata. The seat and venue of arbitration shall be Kolkata, West Bengal, and the proceedings shall be conducted in the English language. The arbitral award shall be final and binding on both parties and may be enforced in any court having appropriate jurisdiction.

Nothing in this clause shall prevent either party from seeking injunctive relief or interim relief from a court of competent jurisdiction, including the Supreme Court of India, if such relief is deemed necessary to prevent irreparable harm or protect vital legal rights pending arbitration.

17. Modifications

Bewolp Technologies Private Limited reserves the full right to revise, update, amend, or replace these Terms at any time and at its sole discretion. Modifications may be made to reflect changes in legal requirements, operational practices, user feedback, technological advancements, or business strategy. Such changes shall be effective immediately upon being posted on the Bewolp platform or communicated to you via push notification, email, or any other means deemed appropriate by us.

Your continued use of the platform after the effective date of any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically to remain informed of any modifications. If you do not agree to the revised Terms, you must cease using the platform immediately and deactivate your account.

We are not obligated to provide individualized notice of changes unless mandated by law. However, significant changes that materially affect your rights or obligations will be highlighted at the top of this document or during your next app session. In case of ambiguity or conflict, the most recently updated version of the Terms shall prevail over previous versions or other policy documents.
